This week, the Harvard Law School Food Law and Policy Clinic published an updated version of its resource titled, Federal Liability Protection for Food Donation: Legal Fact Sheet. Because the Food Donation Improvement Act (FDIA) was signed into law in 2023, new liability protections exist protecting food donors and food recovery organizations from liability for donating and distributing food to people.
The legal fact sheet is intended to provide food donors, food recovery organization, and advocates with up-to-date information about the liability protections that exist for food donation. In addition to the federal liability protections that have been in place since the Bill Emerson Good Samaritan Food Donation Act was originally signed into law in 1996, the guide walks through the FDIA’s new liability protections for direct donations and donations offered at a Good Samaritan Reduced Price.
